Are Amelia County Mugshots Public
Virginia law is specific on adult booking photos. Virginia Code section 2.2-3706 says public bodies engaged in criminal law-enforcement activities shall provide, when requested under FOIA, adult arrestee photographs taken during initial intake after arrest and as part of routine booking procedure. A mugshot is an intake photograph attached to an arrest or booking event. It does not prove guilt. Charges shown near a booking photo can later be amended, reduced, dismissed, nolle prossed, or superseded by indictment or information. Court records after the arrest are the better source for the status and outcome of the case.

Mugshot Removal and Sealing
For official records, removal depends on the legal status of the case and the agency record. Virginia section 2.2-3706 restricts release of sealed and expunged records unless law authorizes dissemination. A dismissed or expunged matter should be handled through the court process first, then through the originating agency if an official public record still appears. The county or jail should not be described as responsible for removing images from unrelated commercial sites.
